House and Property Clearances
Terms and Conditions

These terms and conditions form part of the Contract between you and J2B Logistics Limited for the services we provide. They cover house, estate, tenancy and other property clearances in England and Wales, including the collection and agreed reuse, donation, recycling or disposal of contents.

“We” means J2B Logistics Limited; “you” means the customer. The “Contract” is the agreement between us, consisting of our written quotation, these terms and our written booking confirmation, together with any later changes or additional services we agree with you in writing.

Removals, relocations and transport services that are not part of the agreed clearance are outside these terms unless expressly included in the quotation.

1 Agreeing your clearance

1.1 Our quotation is based on the information you give us about the property, the contents or areas to be cleared, access, parking, known hazards and the work required. It will identify the property, work to be carried out, exclusions, date or period, total price including VAT where applicable, payment dates and any additional charging rates. Quotations remain valid for 30 days unless stated otherwise.

1.2 Cleaning, dismantling, building work, specialist waste removal and delivery of retained items elsewhere are included only if expressly listed in the quotation.

1.3 The Contract begins when you accept our quotation, pay any required deposit and we confirm acceptance of your booking in writing. Writing includes email, text message and other written electronic messages.

1.4 If the information on which our quotation was based changes, or you ask us to carry out additional work, the price may also change. Any changes to the agreed work or price must be expressly agreed and recorded in writing. Where reasonably possible, we will explain and agree any additional charge before carrying out the additional work.

1.5 Nothing in these terms removes any legally binding assurances we have given you or any statutory rights you may have as a consumer.

2 Authority and instructions

2.1 You must own the contents being cleared or have lawful authority from the owner to authorise their removal and disposal. Tell us before booking about any restriction, disputed ownership, probate, estate, tenancy or other issue that may affect that authority. We may ask for reasonable evidence of your authority and may pause or refuse affected work until the position is clear.

2.2 You are responsible for identifying which rooms, areas and items are to be cleared and which must remain. Remove or clearly separate cash, jewellery, important or irreplaceable documents, valuables and other possessions that are not to be cleared.

2.3 We will follow the agreed instructions and will seek clarification where instructions are unclear. The presence of an item within or close to an area being cleared does not by itself authorise its disposal where it has been identified as something that must remain.

2.4 If we discover an item that appears obviously valuable, personal or important and its disposal has not clearly been authorised, we will take reasonable steps to obtain your instructions before disposing of it. We do not provide valuations and cannot guarantee that we will identify every item of financial, sentimental or other value.

3 Disposal, recycling and items of value

3.1 By authorising clearance of an item, you authorise us to remove it and, subject to any specific written agreement, to arrange its lawful reuse, donation, recycling or disposal. Once an item has been collected it may be processed quickly and recovery may no longer be possible.

3.2 Tell us immediately if your instructions change. Where reasonably practicable we will try to prevent an item from being processed, but we cannot guarantee recovery once disposal, recycling, donation or other onward handling has begun.

3.3 We will not sell items for our own benefit, keep them for ourselves, or treat them as payment unless this has been expressly agreed with you beforehand in writing. Any purchase, ownership transfer, resale arrangement or credit against the clearance price must identify the relevant items and financial terms.

3.4 We do not appraise property or warrant that cleared items have no resale value. Unless a separate arrangement has been agreed, the clearance price is for carrying out the agreed service and is not an assessment of the value of the contents.

4 Items requiring special arrangements

4.1 Tell us before booking about asbestos or suspected asbestos, chemicals, fuel, gas cylinders, paint, oils, batteries, medical or clinical waste, firearms or ammunition, contaminated materials, infestations, unusually heavy items or anything else that may require specialist handling or disposal.

4.2 Hazardous, controlled or specialist materials are not included unless we expressly agree suitable lawful arrangements beforehand. Illegal goods will not be accepted.

4.3 If undisclosed hazardous, unsuitable or materially different items are discovered, we may refuse or stop the affected work. We will explain any safe and lawful arrangements that are required and may charge reasonable resulting costs for which you are responsible.

5 Errors and changes to the job

5.1 If either party discovers a material error or omission in the agreed job specification, they must notify the other promptly. We will explain its effect and propose any reasonable changes to the work or price for your agreement. Additional work outside the agreed specification requires a separate agreement.

5.2 A material error is one that significantly affects the contents, waste type, access, time, disposal arrangements or resources required. It does not include our simply underestimating the cost of a correctly described job. We cannot increase a confirmed price merely because our own costs rise.

5.3 If we propose a material change before work starts for reasons outside your responsibility, you may decline the change and cancel the affected work without charge, and we will refund any deposit or advance payment you have made for that work.

6 Price and payment

6.1 A 20% deposit is due on the date shown in your booking confirmation. It is credited against the price and is not automatically forfeited. The balance is due on the agreed payment date shown in the quotation or booking confirmation. If no payment date has been specified, we will notify you in writing of the date by which payment is due.

6.2 The agreed price includes the disposal or other handling costs expressly identified in the quotation. Additional contents, materially different waste, access or conditions, or waiting time caused by circumstances for which you are responsible may require an additional charge. We will explain the reason, calculation and options and seek your agreement before incurring it. Relevant rates must have been disclosed before booking; agreed parking, permit and toll costs are charged at cost.

6.3 We do not charge you for delays, mistakes or additional work caused by us.

6.4 If payment is late, we will give notice and a reasonable opportunity to pay before suspending unstarted work. We may charge simple interest on overdue, undisputed sums at 4% a year above Bank of England base rate. If you genuinely dispute part of an invoice, tell us promptly and pay the undisputed balance. Nothing in these terms affects any legal right you may have to withhold payment.

7 Cancellation or postponement by you

7.1 Tell us as soon as possible in writing if you need to cancel or change the date.

7.2 Where you are a consumer and the Contract was made online, by telephone or away from our business premises, you may have a statutory 14-day cancellation right. Where that right applies, we will provide the required cancellation information before you book.

7.3 If you ask us to begin work during a statutory cancellation period, we will obtain any express request or acknowledgement required by law. If you then cancel after work has begun, you may be required to pay a proportionate amount for services already supplied. Where the service has been fully performed following the required request and acknowledgement, the statutory cancellation right may end.

7.4 Outside any applicable statutory cancellation period, the following maximum charges apply:

  • Notice before the agreed start: Maximum total charge

  • More than 10 calendar days: No charge

  • 48 hours to 10 calendar days inclusive: 20% of the agreed price

  • Less than 48 hours: 50% of the agreed price

7.5 Notice is measured backwards from the booked start time; days and hours are consecutive, including weekends. These are maximums, not automatic fees. Any charge must reflect our reasonable net loss from cancellation, including unavoidable costs and lost profit, after allowing for costs saved and any replacement work. We will take reasonable steps to reduce the loss and explain our calculation on request.

7.6 Payments already made count towards any cancellation charge; they are not added to it. We will refund any excess within 14 days.

7.7 If you ask to postpone the work, we will consider the request reasonably and, if we can accommodate the new date, agree any revised price with you. We will not charge twice for the same loss.

7.8 No cancellation charge applies where you validly cancel because of our material breach.

8 Preparing for clearance

8.1 Give us reasonably accurate details of the contents, access, stairs, lifts, parking and any known hazards. Arrange any parking permits, access permissions or other arrangements that the quotation says are your responsibility.

8.2 Before work begins, clearly identify anything that must remain at the property. Where reasonably practicable, you or an authorised representative should be available to confirm instructions and check the areas being cleared.

8.3 We may refuse or stop work that we reasonably consider unsafe and will discuss any safe and lawful alternative with you.

8.4 Your approval that the clearance has been completed acknowledges that the agreed areas appear to have been cleared. It does not prevent a later claim for concealed damage or an item taken contrary to your instructions.

9 Carrying out and completing the clearance

9.1 We will carry out the agreed work with reasonable care and skill, take reasonable care of your premises and possessions that are to remain, use suitable staff and equipment, and remain responsible for any subcontractors we use.

9.2 We will use appropriately registered waste carriers and authorised facilities where required, and will comply with applicable waste-handling and disposal requirements. We will retain any records required by law and provide available disposal documentation where reasonably requested.

9.3 The agreed work is complete when the specified areas have been cleared and the agreed disposal, recycling, donation or other handling has been carried out. Any agreed items left behind, cleaning standard or unfinished work will be recorded where appropriate.

9.4 We will notify you promptly of significant delays, take reasonable steps to reduce disruption and discuss reasonable alternatives with you.

9.5 You do not have to accept a substitute date or provider. If we cancel or cannot meet an essential agreed date and no acceptable alternative is agreed, we will refund payments for unperformed work within 14 days. This does not affect any right you may have to compensation for our breach.

9.6 If work is delayed or prevented by circumstances outside our reasonable control, we will tell you as soon as reasonably possible, take reasonable steps to reduce the disruption and discuss the available options with you. We will not charge you for costs caused by our own failure, but we may charge reasonable additional costs necessarily incurred because of the external event where those costs were not reasonably avoidable and the relevant charging basis was disclosed before booking.

10 Responsibility and compensation

10.1 We will be responsible for loss or damage to the extent that it results from our failure to use reasonable care and skill or another breach of the Contract. This includes removing or disposing of an item contrary to the instructions we have agreed with you.

10.2 We are not responsible merely because you later regret the authorised disposal of an item, or to the extent that a loss was caused by incorrect or incomplete instructions, a pre-existing fault, or another cause for which we are not legally responsible.

10.3 Responsibility depends on what caused the problem. If both parties contributed to a loss, that will be reflected fairly in any settlement.

10.4 For goods or possessions wrongly damaged or removed, compensation will normally reflect the reasonable cost of repair or, where repair or recovery is not reasonable or possible, the value of the item immediately before the loss, taking account of its age and condition. It does not automatically provide a new replacement for a used item.

10.5 For damage to premises, we will meet the reasonable and proportionate cost of putting right the damage we caused, taking account of whether a local repair would leave a material mismatch.

10.6 Our insurance arrangements do not by themselves determine your legal entitlement. Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence, fraud, or any other liability or remedy that cannot lawfully be excluded or restricted.

11 Reporting loss, damage or incorrect disposal

11.1 Please report any problem promptly after discovery, preferably by email, particularly where an item may still be recoverable. There is no automatic 48-hour cut-off. A later report will be considered on its evidence, although delay may affect a claim where it materially prevents us from investigating what happened, recovering an item or reducing the loss.

11.2 Describe what happened and provide any reasonable evidence you have of the instructions given, ownership, previous condition and value. This may include photographs, inventories, lists, receipts, valuations or other credible evidence. The absence of an original receipt does not by itself defeat a claim.

11.3 Take reasonable steps to prevent further loss and preserve relevant evidence where practicable. We may reasonably ask to inspect damage or obtain an independent assessment.

11.4 Claims must be honest and reflect the actual loss. We may reject any deliberately fabricated or exaggerated part of a claim and will explain our reasons. A mistake or disagreement about value is not by itself fraud. You cannot recover twice for the same loss, so please tell us about any relevant payment from an insurer or other party.

12 Complaints

12.1 Send complaints to the email address above. We will acknowledge them within five working days and aim to give you a full response within 20 working days. If we need longer, we will explain why. Working days exclude weekends and public holidays.

12.2 If you are a consumer and remain dissatisfied after our final response, we will give you details of any independent dispute-resolution arrangement that is available to you and that we are required to participate in. You may still take the matter to court.

13 Personal information and legal rights

13.1 We use personal information to provide quotations, arrange and carry out the clearance, take payment and handle enquiries or claims. We share it only where reasonably necessary or legally required. Our privacy notice explains how we use personal information and your data rights and will be made available when we collect your information.

13.2 These terms are governed by the law of England and Wales. Nothing in them removes any mandatory consumer protection or any right you may have to bring proceedings where you live. If any provision cannot lawfully be enforced, the rest of the Contract remains in effect.
